It
is only upon receipt of a fully completed, signed booking form
and cleared funds that a booking will be confirmed. By signing
the booking form, you agree to rent a villa on the terms
specified and accept the terms and conditions set out
herewith.
Signing the booking form
constitutes a legally binding contract as set out in our terms
below.
The villa you have booked is available only between the dates
specified in our Agreement. Entry to the villa is no earlier
than 4pm on day of arrival and the villa must be vacated by no
later than 11am on day of departure.
The deposit amount to secure the requested dates is shown on
the booking form. The balance due, including a returnable
damage deposit which is also specified, will be due by the
date indicated. If the balance has not arrived by the due
date, the right is reserved to offer those dates to other
clients.
When booking within 10 weeks of your arrival date, the full
rental and damage deposit in the sums specified are payable in
full.
In respect of villas where
rentals are quoted in currencies other than UK Pounds
Sterling, an adjustment may be required due to currency
fluctuations. We will advise you of that at time of payment.
You can protect against future currency fluctuation by paying
for the rental in full in advance.
In all cases, a formal acknowledgement letter/fax and or
e-mail confirming receipt of funds will be sent
to you once your cheque has cleared or bank transfer
completed. It is suggested that wire transfers or Bankers
cheques will speed up clearance of funds.
Upon receipt of the total amount due for the rental, any
necessary information will be forwarded to you, ie: maps,
contact and key collection details etc.
No refund will be given in the event of any cancellation by
you. Both the deposit to secure dates and balance are non
refundable. Only the damage deposit is refundable to the sum
specified on the booking form which is paid with your final
balance.
It is strongly recommended you take out travel insurance against
sickness, personal accident, cancellation cover, etc., as no
responsibility for any losses howsoever incurred will be
accepted.
Upon signing a booking form,
you agree to become liable to paying all rental costs and the
form constitutes a contract between the two parties.
Whilst properties are
maintained to a high standard, we cannot accept responsibility
for the breakdown or absence of equipment and facilities
offered. If any facility offered is not functional or
available at any time during the rental, the management
company should be informed and reasonable effort will be made
to have such facility replaced or repaired as appropriate.
The right is reserved, should the booked property be
unavailable for any reason beyond our control, to provide
alternative accommodation of an equal or superior standard or
offer a 100 per cent refund. No claims for additional sums in
lieu of compensation will be considered.
Return of villa keys are to be as specified by the local
representative or ourselves. Keys not returned within 14 days
of your departure from a villa will entail a deduction as
specified for the villa rented, as the front lock and other
locks will need to be changed.
Your damage deposit will be returned 14-21 days after your
departure from the villa and subject to the return of all
keys. Any deductions as a result of damage will be assessed by
the local representative and notified to us. Any agreed
deductions for services such as extra maid service, cot/high
chair hire and telephone usage will also be deducted at this
time, unless they have been paid in advance.
This contract is for vacation/holiday rentals only. You should
indicate if there are to be any commercial activities carried
out while at the villa or an excess number in your travel
party than was originally booked.
We are not responsible for any damages, injuries or losses
suffered by you or anyone staying at the villa and we
recommend that you take out travel insurance to cover your
party.
This contract shall be governed and interpreted by English Law
and in the event of any dispute arising between the parties
the Courts of England shall have jurisdiction. The place of
performance of this contract is England.
